Busciglio SHERIDAN & SCHOEB

Strategic Counsel for
MILITARY FAMILIES IN TRANSITION

At Busciglio Sheridan & Schoeb, we understand that military divorce comes with a unique set of legal, financial, and logistical complexities. Whether you’re an active-duty service member, a military spouse, or a veteran, we guide you through the process with clarity, compassion, and the strategic insight needed to safeguard your rights, your benefits, and your long-term security.

Your service shouldn’t complicate your separation

Military life doesn’t just complicate divorce emotionally, it complicates it structurally.

PCS orders, deployments, and federal benefit rules collide with custody, relocation, and jurisdiction. You need a legal team that knows Florida family law and how the military system actually works. We bring clarity, precision, and strategy to protect what you’ve earned and secure the path forward so you can focus on the road ahead.

Why military divorce requires a different approach

Military divorce isn’t just complex — it’s fundamentally different. Most lawyers don’t understand the system you operate in: how PCS orders disrupt residency, how DFAS handles pay, or how deployment schedules collide with custody court dates. They treat military service like a detail, not the defining structure of your life. We don’t make that mistake.

Our team is built to navigate the intersection of military duty and Florida family law. We understand the real-world implications of SCRA protections, command delays, 10/10 rule thresholds, BAH calculations, and parenting plans that collapse under relocation orders. You won’t have to educate us. You’ll have attorneys who already know what’s at stake — and how to protect it with precision and strategy.

01
Jurisdiction & Residency
Military families often move frequently, which can make filing for divorce complicated. Florida allows for flexible filing options if either spouse resides in the state, if the service member is stationed here, or if Florida is the service member’s legal residence. One spouse must have lived in Florida for at least six months prior to filing.
02
Service Members
Civil Relief Act (SCRA)
Active-duty servicemembers are entitled to certain protections under SCRA, including delays in divorce proceedings and protection from default judgments. We ensure these rights are enforced and that your service does not become a legal disadvantage.
03
Division of Military Benefits
Military pensions, Thrift Savings Plans (TSP), and Survivor Benefit Plans (SBP) are treated as marital property and are subject to division. We help you understand what’s at stake, how benefits are calculated, and what you or your spouse may be entitled to, especially in cases involving the 10/10 rule or DFAS direct pay eligibility.
04
Healthcare &
Base Privileges
In some cases, former spouses may retain access to military benefits like TRICARE and commissary privileges, depending on the length of the marriage and years of military service. We clarify eligibility under the 20/20/20 and 20/20/15 rules and help preserve access where possible.
05
Child Custody
& Time Sharing
Deployment should never mean losing parenting time. Florida law prohibits permanent custody modifications based solely on deployment. We work to create time-sharing agreements that account for service-related absences, Family Care Plans, and relocation due to military orders — all while prioritizing the best interests of your child.
06
Child Support
 & Alimony
Military compensation includes more than just base pay — allowances such as BAH and BAS are considered in support calculations. We work to ensure child support and alimony reflect your true income and financial responsibilities, and we help enforce support obligations in compliance with military regulations.
07
Deployment
 & Delays
Military duties can impact the timing and flow of a divorce. Courts may issue temporary orders for support or custody during deployments, and in some cases, proceedings can be delayed to accommodate your service schedule.
08
Specialized Legal Representation
Military divorces require attorneys who understand both the law and military life. Our team is experienced in handling these cases with the level of detail, sensitivity, and strategy they deserve — whether you’re filing from Tampa or are stationed overseas.
